In any case the relationship is formed by the User's acceptance of the applicable Platform Terms presented at signup and/or made available through the Site.

(a) Consvert shall not be liable to any User for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business opportunity, goodwill, anticipated savings, or data, in each case howsoever arising from or in connection with the Site, the Site Content, the Audit, the Lead-Magnet Materials, or these Terms, whether in contract, tort (including negligence), under statute, or otherwise.
(b) Consvert's aggregate liability to any User in respect of any and all claims arising from or in connection with the Site, the Site Content, the Audit, the Lead-Magnet Materials, or these Terms shall not exceed one hundred Dollars (USD 100). The Parties acknowledge that this cap reflects the absence of consideration paid by the User to Consvert in respect of access to the Site.
